The learned Counsel Mr. Yashpal Thakur appearing for the respondent no.2 original complainant has submitted that in view of the Apex Court judgment in the case of Dashrath Rupsingh Rathod Vs. State of Maharashtra & Anr. 2014 STPL (Web) 499 SC, the C.C. Nos. 5971/SS/2009, 4921/SS/2009, 5585/SS/2009 Uday S. Jagtap

2365-14-wp-c=.doc and 5350/SS/2009 have already been transferred and registered in the competent Court in Kolkatta. The proceedings of the trial Court from which these Writ Petitions arise are no longer in Mumbai Court and the Writ Petitions have become infructuous. 2.

Hence, the Writ Petitions are dismissed with liberty to the petitioners to file appropriate applications in case the files are re-transferred to Mumbai in view of Ordinance No.6 dated 15.06.2015.
