The applicant is seeking regular bail in Crime No.986 of 2020, registered with Borivli Police Station, for an offence punishable under Sections 354 of the Indian Penal Code and 10 of Protection of Children from Sexual Offences Act, 2012.

The Complainant is present in the Court and made a request to the learned APP to argue the matter.

The applicant has already suffered incarceration for more than a period of one year. The maximum punishment provided under the offence is of five years. In the aforesaid backdrop, in my opinion, a case for grant of bail is made out. The application is allowed on following conditions :

O R D E R

(i) The applicant be released on bail in Crime No. 986 of 2020, registered with Borivli Police Station, for an offence punishable under Sections 354 of Indian Penal Code and 10 of Protection of Children from Sexual Offences Act, 2012, on furnishing P.R. bond in the sum of 25,000/- with one or more local sureties in the like amount. (ii) Till conclusion of trial, the applicant shall remain outside the jurisdiction of the concerned Police Station. (iii) The applicant shall neither influence the prosecution witnesses in any manner nor tamper with the evidence and shall not
