Hence, we pass the following order:

(i) The appeal is disposed of in terms of the consent terms;

(ii) The Award/Decree shall be drawn in terms of the

(iii)The appellant shall be entitled to refund of Court fees as per the Rules;

(iv)Pending civil application does not survive and the same is disposed of.
