Rule. By consent, rule is made returnable forthwith. 3.

The petitioner has preferred an application for furlough on 1st December, 2014 to enable him to be released on furlough in the year 2015. The said application came to be rejected by an order dated 20th January, 2015. The Appeal against the said order of rejection was dismissed by order dated 17th April, 2015. Hence, this Petition.

Learned APP has pointed out that thereafter on 1st June, 2015 the petitioner preferred a fresh application for furlough. The said application came to be granted and pursuant thereto the petitioner was released on furlough on 16th October, 2015 for a period of 14 days. 5.

In view of the fact that the petitioner has been released on furlough in the year 2015, we are not inclined to interfere. Hence, Rule is discharged.

Office to communicate this order to the petitioner, who is in Nashik Road Central Prison. The fees to be paid to the appointed counsel are quantified at Rs.2,500/-.
