Heard learned counsel appearing for the petitioner. Apart from the fact that the petitioner has a statutory remedy available against the impugned order dated 11th March, 2014, we find from the impugned order that the issue of tenability of the complaint filed by the respondent has been expressly kept open by the State Consumer Disputes Redressal Commission, Maharashtra, Mumbai. It is observed that the same will be decided while finally deciding the complaint on merits.

Therefore, there is no reason to interfere in the writ jurisdiction of this Court under Article 226 of the Constitution of India. By keeping all issues open, we reject the petition. (A.K.MENON, J.) (A.S.OKA, J.)
