P.C.

Having heard the learned counsel for the parties, we find that the question involved in this case is already decided on 22/12/2017 by this Court, in the case of Motilal S/o Namdeo Pawar vs. Scheduled Tribe Certificate Scrutiny Committee, Nashik & others (Writ Petition No. 7 of 2017). Additionally, we find that the common order which is assailed in this writ petition was challenged by Iresh Siddharam Mashal Date:

2018.08.23 16:24:08 +0530 Iresh Siddharam Mashal

2 901.6752.18 wp.doc by the petitioner's niece Shweta Dilip Gaikwad in Writ Petition No. 7544 of 2018 which was allowed on 18/07/2018 and the order dated 30/05/2018 was quashed for the said petitioner and the Committee was directed to issue the caste validity certificate to the petitioner of that petition within one week.

In the circumstances, for the reasons stated in the said orders dated 22/12/2017 and dated 18/07/2018, we allow this petition and direct Caste Scrutiny Committee to issue caste validity certificate to the petitioner within 2 weeks from today. Till the certificate as aforesaid is issued, no coercive steps be taken against the petitioner by respondent no. 4 Collector. The petition is allowed and disposed of in the above terms. No order as to costs.
