DATED : 18th JULY, 2022 P.C:- On 28/6/2022, the applicant was admitted to interim protection. Considering the injury certificate which refer to one injury being grievous in nature, the applicant was directed to report to the police station and it is informed that he has reported. The learned APP state there are two antecedents against the applicant and the report from the police station refer to one C.R.No.87/2014 u/s.379 r/w Section 34 IPC and C.R.No. 453/2022 u/s.186, 506 r/w Sec.34 IPC. Apart from this, a Tilak
2/2 27 ABA 1687-22.doc proposal for an externment was also forwarded to the Superior Officer but it is still pending.
The learned APP raise an apprehension that since the complainant and the applicant are residing in the said area, there is every possibility that he will create some law and order situation or repeat the incident. Learned counsel for the complainant also express the same apprehension.
While confirming the order dated 28/6/2022, it is made clear that any further accusation faced by the applicant at the instance of the complainant, in respect of any threat or incident of the nature which resulted into registration of the C.R, the complainant as well as the prosecution will be at liberty to move an application for cancellation for bail. Application disposed off.
