Learned counsel appearing for the Petitioner as well as the learned counsel appearing for Respondent Nos.4 to 8 state that the dispute between the contesting parties is settled in terms of the Consent Terms. They tender the Consent Terms. 2.

Ms. Dimple Tejani, learned counsel appearing for Respondent No.4-Bank tenders extract of the minutes of the Board Meeting held on 30th September 2023 and more particularly of Board Resolution 1/2

The Consent Terms are signed by the Petitioner i.e. Kavita A. Jethwa, Sunil K. Avhad, authorized signatory on behalf of Respondent No.4-Bank, added Respondent No.5-Navinchandra Bharakhda, added Respondent No.6-Ashok Jethwa, added Respondent No.7-Mihir Jethwa and added Respondent No.8-Triveni Developers through partner Mihir Jethwa.

The signatories to the Consent Terms are present in Court and state that the dispute involved in the Writ Petition is settled in terms of the Consent Terms. Their signatures on the Consent Terms are identified by the respective Advocates.

Accordingly, the Consent Terms are taken on record and marked "X" for identification. The said extract of resolution authorizing Sunil K. Avhad to sign the Consent Terms on behalf of Respondent No.4-Bank is also taken on record and marked "X1" for identification.

Accordingly, the Writ Petition is disposed of in terms of the Consent Terms with no order as to costs.
