This application is preferred by plaintiff for condonation of 18 days delay in filing Appeal from Order challenging the order dated 09.05.2015 passed by Bombay City Civil Court at Bombay in draft Notice of Motion in L.C. Suit No. 1035 of 2013 declined to grant ad-interim relief.

Considering the submissions made by learned counsel for the applicant and averments made in civil application, I am satisfied that applicant has made out the case for allowing the civil application. At the same time, applicant to pay cost of Rs.750/- Sneha Chavan 1/2

PR 13 caa 1006-15=.doc to respondent nos. 1 and 2 as well as respondent no.3.

Hence, the following order.

i) Delay of 18 days in filing Appeal from Order is condoned.

ii) Applicant to pay cost of Rs.750/- to respondent nos. 1& 2 as well as respondent no.3 within two weeks from today.

iii) Civil Application is disposed of accordingly.
