The applicants are apprehending their arrest in Crime No.158/15 registered at Sanghavi Police Station, Pune for offences punishable under Section 498A, 313, 323, 504 read with Section 34 of the I.P.C. On 30.6.2015, this Court had granted interim protection to the applicants. The applicants had directly approached this Court since the Bar Association of Pune Court was on strike and therefore, this court entertained the application and granted interim relief to the applicants. Learned counsel for the applicants makes a statement that now the strike has been called off. In view of this, it would be necessary to relegate the matter to the appropriate court having jurisdiction under Section 438 of the Criminal Procedure Code. Hence, on this ground, the learned counsel for the applicants seeks liberty to withdraw the
ASN 2/2 aba-909-15 application. Liberty as payed for is granted in the interest of justice with further liberty to approach the Court of Sessions at Pune. In the eventuality, the application under Section 438 is filed on or before 30.7.2015, the learned Sessions Judge shall consider the application on its own merits. In view of this, the applicants stand protected till 5.00p.m. of 30.7.2015.
ORDER
a) Application is disposed of as withdrawn.
b) Interim relief granted in favour of the applicants vide order dated 30.6.2015 is extended till 5.00 p.m. of 30.7.2015. (SMT. SADHANA S. JADHAV, J.)
