While the order was being dictated, the learned advocate appearing on behalf of the appellant made a statement that his clients are ready and willing to file affidavit cum undertaking that they will comply with the notice issued by BMC under section 53(1) of the MRTP Act, 1966 dated

AO-807-15 8/5/2015. At his request the matter was adjourned to today for filing affidavit cum undertaking.

Today, when the matter was called out none appears on behalf of the appellant. Hence the Appeal from Order is dismissed for default. 5.

In view of dismissal of the Appeal from Order, nothing survives in the Civil Application. The same stands dismissed as infructuous.
