P.C.:- By the present Application, the Applicant-Original tenant, has sought permission of this Court to deposit arrears of interim compensation of Rs.5,000/- per month for the months of April, May and June 2021 aggregating to Rs.15,000/- in the Registry of the Small Causes Court at Mumbai.
Record indicates that, by an Order dated 8th July, 2021, this Court has directed the Applicant to deposit Rs.7,500/- per month, as an adhoc rent in the Registry of Small Causes Court at Mumbai on or before 10th day of every month from the month of July-2021. The learned counsel for the Applicant submitted that, as there are arrears of rent of above said three months, the Registry of Small Causes 1/2
ssm 2 8-ia1691.21-in-crast11638.21.doc Court at Mumbai did not accept the rent of the month of July-2021. In view thereof, the Applicant is permitted to deposit the arrears of Rs.15,000/- towards interim compensation for the months of April, May and June, 2021 in the Registry of the Small Causes Court at Mumbai within a period of two weeks from today. Application is accordingly allowed in terms of prayer clause (a).
Apart from the arrears of the interim compensation, the Applicant is also permitted to deposit the arrears of contractual rent, if any, in the Registry of the Small Causes Court at Mumbai and to continue to deposit contractual rent and interim compensation during the pendency of the present Revision Application in the Registry of the Small Causes Court at Mumbai.
