Mr. Harshad Sathe, Advocate is allowed to withdraw his appearance on behalf of the Respondent. Mr. S.P. Saroj i/b. Mr. M.N. Vanshiv and Associates has filed Vakalatnama on behalf of the Respondent which is taken on record. 2.

Heard the learned Advocates appearing for the parties and the following order is passed by consent :

i.

Marriage Petition No. 372 of 2014 filed by the Respondent husband in Family Court, Pune is transferred to the Family Court, Kolhapur. ii.

The learned Principal Judge, Family Court, Pune shall ensure that the papers and proceedings of Marriage Petition No. 372 of 2014 are received by the Principal Judge, Family Court, Kolhapur on or before 7 th October, 2017.

iii.

The parties as well as the learned Principal Judge, Family Court, Pune and

Nitin 2 / 2 5-MCA-246-2017.sxw the Principal Judge, Family Court, Kolhapur to act on an authenticated copy of this order.

iv.

Parties and / or their Advocates shall appear before the Family Court, Kolhapur on 9 th October, 2017 at 11.00 a.m. and obtain appropriate orders / directions. v.

The Principal Judge, Family Court, Kolhapur shall ensure that Marriage Petition No. 372 of 2014 shall be heard on the days when the Respondent visits Kolhapur to attend Criminal Appeal No. 182 of 2015 and Petition No. E-51 of 2015 pending before the Family Court, Kolhapur.

vi.

The Family Court, Kolhapur shall not grant adjournment/s to the parties unless absolutely necessary. The Family Court, Kolhapur too shall not adjourn the matter unless absolutely necessary.

vii.

The Family Court, Kolhapur shall endeavour to dispose off Marriage Petition No. 372 of 2014 within a period of six months from the date of this order. viii.

All contentions of the parties are kept open. 3.

Since the Respondent has remained present before the Court and has complied with the undertaking given by him to this Court on 11 th September, 2017, the order issuing bailable warrant against the Respondent dated 21 st September, 2017 stands cancelled / recalled.

The above Misc. Civil Application is accordingly disposed off. ( S.J.KATHAWALLA, J. )
