Heard learned Advocate Mr. Rishi Bhuta for the Applicant and the learned additional public prosecutor for the State.

The chargesheet against the applicant has not been filed as there is a direction from the division bench for not filing the chargesheet. It appears that the applicants have challenged the FIR filed against them for the offences punisable under sections 498A and 406 r/w. section 34 of the Indian Penal Code. The applicants are permanent residents of Mumbai and they want to go abroad on tour, as both of them are senior citizens. I think there should not be any hesitation in granting Borey 1/2

spb/ 10apl605-15.sxw the prayer. There is no apprehension of their absconding or fleeing the justice. Hence, I pass following order : i.

The applicants are permitted to travel abroad for a period of two months w.e.f. 1st August,2015. ii.

Both of them shall execute a bond of Rs. One lakh each that if they do not return within the period of two months they will indemnify the government to the extent of Rs. One lakh each.

iii.

The pass-ports of the applicants shall be returned to them by the police after retaining the xerox copies thereof.

The criminal application stands disposed of in the above terms.
