This is an application for relaxation of condition of attending police station imposed vide order dated 17th July, 2019, passed by this Court while granting bail to the applicant. The applicant was directed to attend concerned police station on every Saturday between 10:00 am. to 11:00 a.m., for a Digitally signed by RajeP. Aher Date:
2020.12.19 12:22:04 +0530 period of 12 months, and, thereafter, on the frst Saturday of RajeP.
Aher every alternate month, between 10:00 a.m. to 11:00 a.m., till conclusion of the trial.
rpa 2/3 10-ia-1431-2020.doc It is submitted that the applicant has complied the condition by attending the police station. The frst part of the condition is already fulflled. Presently, he is required to attend on frst Saturday of every alternate month between 10:00 a.m. to 11:00 a.m. While granting bail to the applicant, it was observed that money received from the victims were deposited into the account of the co-accused who were released on bail by the Sessions Court.
Learned APP submitted that to keep the check on the applicant, it is necessary to direct him to attend concerned police station.
By order dated 17th July, 2019, the applicant was directed to attend police station on every Saturday between 10:00 am. To 11:00 a.m., for a period of 12 months. It is not reported that there is non-compliance of the condition. The period of 12 months is already over and presently he is required to attend the police station on the frst Saturday of every alternate month, between 10:00 a.m. to 11:00 a.m. Considering the aforesaid circumstances, the relaxation of condition of attendance can be granted by directing the applicant to attend
rpa 3/3 10-ia-1431-2020.doc the concerned police station once in four month on frst Saturday of the month between 10:00 a.m. to 11:00 a.m., till further orders. Hence, I pass the following order:
:: O R D E R ::
(i) Interim Application No.1431 of 2020, is allowed; (ii) The condition imposed vide order dated 17th July, 2019, is modifed and relaxed to the extent that the applicant shall attend the concerned Police Station once in four months on frst Saturday of the month between 10:00 a.m. to 11:00 a.m., till further orders;
(iii) Interim Application No.1431 of 2020, stands disposed of accordingly.
