This petition is filed challenging the ex-parte award passed by the Industrial Court at Thane.

The learned counsel for the Petitioner states that the Petitioner has remedy of filing an application for recalling the exparty award and the Petitioner intends to take recourse to the said remedy. The learned counsel therefore, on instructions seeks leave to withdraw the petition. The instructions to that effect which are in the form of the copy of an email dated 26.07.2022 are taken on record and marked "X" for identification. Sneha Chavan page 1 of 2

The petition is disposed of as withdrawn, with no order as to costs.

Needless to mention that the Petitioner would be at liberty to approach the Industrial Tribunal at Thane with appropriate application for setting aside the ex-parte award. If such an application is made, the Industrial Tribunal to decide the same on its own merits and in accordance with law.

It is made clear that this Court has not expressed any opinion on the merits of the matter.
