1] By a reasoned Order dated 20 th June 2017 the applicant was granted interim relief with a direction to attend the Investigating Officer on stipulated dates and to join the process of investigation. 2] Perused the record of investigation.

The record indicates that, the first informant and the applicant were having love-affair and physical relations since year 2008 and it is only when the applicant failed to comply with the promise to marry with th first informant, the present crime is registered. After perusing the record, this 1/2

aba.1048-2017.doc Court is of the view that, the custodial interrogation of the applicant for further investigation of the present crime, is not necessary. 3] In view thereof, the interim relief granted by an Order dated th June 2017 is confirmed. However, the condition to attend the Nalasopara Police Station, District- Palghar is hereby waived. Application is allowed in the aforesaid terms. 4] In view of Order passed in A.B.A. No.1048 of 2017, Criminal Application No.770 of 2017 for intervention does not survive and the same is accordingly disposed off.
