By this interim application, the applicant seeks extension of the temporary bail granted to him by this Court vide order dated 19th April 2023, for a period of 45 days i.e. till 7th August 2023. 2.

Vide order dated 19th April 2023, we had allowed Interim Application No.1143 of 2023 seeking temporary suspension of the applicant's sentence and enlargement on bail, for a temporary period 1/3

of two months, on the premise that his wife was unwell and was to undergo spine surgery. Accordingly, the interim application was disposed of.

Today, we are informed, that till date the surgery has not been performed and the same is likely to be performed in the second week of July and hence the present interim application. 4.

Vide order dated 19th April 2023, the petitioner was directed to surrender within two months from the date of his release i.e. on 22nd June 2023.

Since, there is no date fixed for the surgery of the applicant's wife, we are not inclined to extend the period. The applicant is accordingly directed to surrender on 22nd June 2023. 6.

Needless to state, that the applicant is at liberty to file a fresh application, in the event, date is fixed for surgery of his wife, which will be decided on its own merits, in accordance with law. 2/3

Application is accordingly disposed of on the aforesaid terms.
