P.C. :- P.C. :- The proceedings arising out of offence registered under Section 498A, 406 and 34 of IPC are pending before the learned Metropolitan Magistrate, 10th Court, Andheri, Mumbai. The FIR has been registered as long back as on 18.4.2007 and the charge-sheet was filed on 18.6.2008. The trial has commenced however, has not progressed till the year 2014 as the first informant in spite of numerous opportunities granted has not made herself available for cross-examination. The Petitioners herein are senior citizens being aged 70 and 73 years respectively. Their agony is rising on account Shivgan

It is not possible for us to grant reliefs which have been sought vide this petition ie. quashing of the proceedings at this stage. However, having regard to the fact that trial has already commenced, we direct the trial Court to complete the proceedings latest by 28.2.2018. Having regard to the nature of directions, the need to issue notice to the Respondent No.2 is obviated. The Writ Petition is accordingly disposed of.
