This is an application under Section 439 of the Cr.P.C. for bail in CR No. I 410/2017 dated 9.10.2017 registered with Narpoli Police Station, District Thane under Sections 420, 465, 467, 471 read with 34 of the Indian Penal Code. 2.
Mr. Patil, the learned counsel appearing for the applicant submitted that, the allegations made against the applicant is only under Section 420 of the Indian penal Code. That, the parties herein have arrived at a settlement and have entered into consent terms. The consent terms dated 28.7.2018 are produced on record. The applicant who is in Jail have signed Page-1/3
those consent terms before the Senior Jailor of Taloja Central Jail, New Mumbai. The complainant Shri. Kantibhai Panchal has also signed the said consent terms. The learned Advocate appearing for respondent No.2 admitted the fact of execution of consent terms. The said consent terms are taken on record and marked "X" for identification. The undertakings mentioned in the consent terms are treated as undertakings given to this Court.

In view of the consent terms and without going into the merits of the matter the applicant can be released on bail. Hence, the following order.
a) The applicant be released on bail in CR No.I 410/2017 dated 9.10.2017 registered with Narpoli Police Station,District Thane on his furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount.
b) After his release from Jail, the applicant shall attend the Narpoli Police Station on every first Monday of the month between 11.00 a.m. and 1.00p.m.
c) The applicant shall attend all the dates before the Trial Court unless precluded for medical reasons.
d) The applicant shall not tamper with the evidence and/or Page-2/3
influence the prosecution witnesses.
