This is the second bail application preferred by the applicant. 2.

At the outset, learned APP makes a statement that all the witnesses have been examined in the aforesaid case, except the Investigating Officer.

Learned Counsel for the applicant submits that for the last 1 1/2 year the Investigating Officer has not appeared before the trial Court, as a result of which the trial could not conclude.

Learned APP on instructions makes a statement that the Investigating Officer will remain present on the next date in the trial Court or on the date fixed by the trial Court for appearance of the Investigating Officer, for recording of his evidence.

Considering that all the witnesses have been examined in the aforesaid case and only one witness is remained to be examined, it would be appropriate to direct the trial Court to conclude the trial as expeditiously as possible and in any event within 3 months from the date of receipt of this order. Order accordingly.

The Application is accordingly disposed of on the aforesaid terms.
