DATED : 30th JUNE, 2022 P.C:- The applicant is the husband of the complainant, who lodged a report with Vanrai police station on 25/3/2022, which resulted in invoking Section 498 r/w Section 34 of the IPC against his entire family. The learned counsel for the applicant make a categorical statement that all the other accused persons are released on bail in anticipation of their arrest by the Sessions Judge, Borivali.

The complainant allege that she was married to the present applicant on 19/4/2019 and in the long complaint, the accusations faced by the husband are, that he used to consume liquor while returning home and used to raise a quarrel and used

2/3 4 ABA 1703-22.doc to abuse her at times. It is alleged by her that she made grievance about her behaviour to her mother-in-law, but she was asked to remain silent. As far as the demand of amount is concerned, she specifically attribute that her mother-in-law, father-in-law and sister-in-law used to take jibe at her, and assault and abuse her, causing mental and physical harassment.

Perusal of the complaint would reveal that the allegations are vague in nature, and in the aforesaid circumstances, the custodial interrogation of the applicant is not necessary. Subject to he rendering co-operation to the Investigating Officer, he is entitled to be released on bail in the event of his arrest. Hence, the following order :-

O R D E R

(a) In the event of his arrest, the Applicant - Satish Kumar, J in connection of C.R.No.158/2022 registered with Vanrai police station shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount.

(b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.

3/3 4 ABA 1703-22.doc (c) The Applicant shall attend the concerned Investigating Officer on 4th, 5th and 6th July 2022 between 2.00 pm to 5.00 p.m and thereafter as and when directed.
