The above Petition is filed challenging the order dated 18th December, 2019 passed by the Additional District Magistrate under Section 14 of the SARFAESI Act, 2002.

The learned advocate appearing on behalf of the Petitioner submitted that to challenge the said order the Petitioner has already approached the DRT by filing a Securitization Application. That Securitization Application is also disposed of and possession of the JULY 28, 2023 Utkarsh

SB.901.wp.9306.2023.doc Secured Asset is already taken and handed over to the 1st RespondentFinancial Institution. He therefore seeks leave to withdraw the above Writ Petition.

In these circumstances, the Writ Petition is dismissed as withdrawn. However, there shall be no order as to costs. 4.
