This revision is filed by original accused Unis Alim Gazi, Proprietor of Saibaba Arth Movers, who came to be convicted under Section 138 of Negotiable Instruments Act, by the trial court against which appeal preferred before the learned Additional Sessions Judge, Pune, came to be dismissed.

11-REVN-139-2016.doc Record reveals that this court by its order dated 18th August 2016 referred the matter for mediation. Learned counsel for both the sides and parties who are present in person had submitted that mediation is successful. However, no mediation report is yet received on record.

In that view of the matter, parties to place on record joint pursis to this effect.

Original complainant, as well as accused who is applicant, are present along with their respective counsel and have placed on record terms of settlement, which are taken on record. They have also admitted the same, including allowing respondent / original complainant to withdraw amount which is deposited before the learned Sessions court.

Having considering facts as aforesaid, revision stands disposed of in terms of Consent terms.

In view of this, Criminal Application No.355 of 2016 becomes infructuous and stands disposed of.

Co-ordinator, Main Mediation Center, High Court, Bombay, is requested to obtain the Mediation Report for record purposes. Parties to act on a copy of this order duly authenticated by the Sheristedar of this court.
