DATED : 1st AUGUST, 2022 P.C:- In the wake of the order dated 26/7/2022, the complainant's supplementary statement is recorded on 29/7/2022.

The learned APP has placed the said statement on record which is marked as 'X' for identification. In the said statement, the complainant has specifically admitted that the applicants have agreed to provide him two commercial galas with carpet area of 560 and 898 sq.ft

2/3 9 aba 1710-22.doc respectively, with two podium parking in the proposed "9, Rajgir' building. He admit that accordingly, an agreement was executed with Shri Deepak Jain and Jitendra Girdharilal Asudani, who has signed on behalf of Kavita Construction and the said agreement was registered with Assistant Registrar, Borivali, on 18/7/2022. Based on the above, he has agreed to withdraw his case.

In the wake of the above, the applicants deserve protection from arrest by the following order :-

O R D E R

(a) In the event of their arrest, the Applicant no.1 Girdharilal Sukarmadas Asudani, applicant no.2 Jitendra Girdharilal Asudani in connection of C.R.No.647/2022 registered with Borivali police station shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- each with one or two sureties of the like amount.

(b) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.
