Heard Mr.Pramod Pawar, learned Counsel for the applicant and Mr.V.S. Gokhale, learned Counsel for respondent No.5.

This is an application for bringing L.Rs. of the sole respondent - Appasaheb Ganesh Kale, since deceased, on record. Office remark shows that respondents No.i, ii(a), ii(b), ii(c), iii(b), iv, v & vi are served. As far as respondent No.ii(d) is concerned, public notice was issued for serving said respondent and the Advocate for the applicant has filed affidavit of service with paper cutting on 15.6.2018.

Order dated 28.3.2018 records that in paragraph-4 of C.A. No.169/2018, the applicant stated that on behalf of respondent No.1(iii)(a),

2/2 9.CAC.201-16.doc [Ramdas v Appasaheb] respondent No.ii(b) accepted the service of Civil Application No.201/2016. However, despite service none appears on behalf of the L.Rs. of said respondent.

In view thereof and for the reasons stated in the Application, Civil Application is allowed in terms of prayer clause (a). Amendment in the main C.R.A. shall be carried out within 14 days from today. Order accordingly.
