. Heard learned Counsel for the parties. The Petition is disposed of by consent in terms of the following order. : O R D E R :

i) The Industrial Court Thane, shall dispose of Complaint (ULP) No.126 of 2016 as expeditiously as possible and in any event, within three months from today;

ii) In the meantime, the Respondents shall not initiate any disciplinary proceedings against the members of the Petitioner-Union for having remained absent on Sundays;

18. wo 7148-16.doc iii)In case, Respondent No.1-Company makes a special requisition against the members of the Petitioner-Union for working on holidays (Sundays) and the workers are not in a position to work on such days, they shall intimate Respondent No.1-Company in writing about their inability;

iv) Both parties shall remain present before the Industrial Court, Thane with an authenticated copy of this order on 1 July 2016 at 11.00 a.m.
