The applicant was granted interim relief by an Order dated 29.6.2018 and directed to attend the Investigating Officer on stipulated dates.

Heard the learned counsel for the applicant and the learned APP. Perused the record of investigation. 3.

The deceased Smt. Namita Choudhary was doing the business of on line trading of shares through the applicant. That the deceased suffered huge losses in the said business and therefore was under depression for few days prior to her commission of suicide on 15.8.2017 before 4.40p.m. During the house search of the deceased a suicide note was found, wherein

23-aba-1134-18.doc no blame has been put on the applicant and in fact it is stated that, the deceased was living due to the help of the applicant and after her death all the relevant papers may be handed over to the applicant.

Prima facie it appears that, the applicant never aided or abetted the deceased in commission of suicide and in fact has helped the deceased in her difficult times.

The record of investigation indicates that, in pursuance of the Order dated 29.6.2018, the applicant has attended the Investigating Officer and has joined the process of investigation.

In view thereof, the applicant is entitled to be protected by pre-arrest bail.

6. Interim relief granted by Order dated 29.6.2018 is hereby confirmed however, the condition to attend to the Investigating Officer is waived.
