1) This is an application seeking permission to travel abroad at Singapore during the period from 15th August 2016 to 15th January 2017. 2) The applicant is acquitted in Special Case No.7 of 2000 by the learned Special Judge, Solapur by its Judgment and Order dated 17th August 2002.
3) The present appeal is preferred by the State. The applicant was earlier permitted to travel abroad for a period of six months by Order dated 2.3.2012 passed in Criminal Application No.170 of 2012 by this Court. It
appears from record that the applicant had returned to India within the stipulated period and did not violate any conditions thereof. The applicant now intends to visit Singapore as his daughter is settled there. He has submitted that his daughter has delivered a child on 5.4.2016 and she now intends to go back to Singapore. He stated that he desires to accompany his daughter to Singapore and wants to stay there during aforesaid period. 4) The Assistant Commissioner, Anti-Corruption Bureau, Solapur has submitted a report to the learned APP dated 11.7.2016 stating that the said agency has no objection, if permission granted to the applicant to visit Singapore, during the said period on appropriate conditions. 5) In view of the no objection given by the Investigating Agency, I am inclined to grant permission to the applicant to travel to Singapore during the period from 15.8.2016 to 15.1.2017.
6) Hence the following Order:- (i) The applicant is permitted to leave India from 15th August 2016 to 15th January 2017 subject to submitting cash surety of Rs.1,00,000/- in the Registry of this Court.
(ii) The applicant is permitted to travel Singapore only and shall not visit any other countries. The applicant shall stay at the address mentioned in para-8(c) of the application at Singapore. (iii) The applicant shall also provide contact number/telephone number of his daughter at Singapore.
(iv) The applicant shall return to India on or before 15th January 2017. (vi) After his return to India, the applicant shall intimate the said fact to the concerned Assistant Registrar of this Court within one week, with whom the aforesaid deposit is made.
(vii) On his return to India in stipulated period the security deposit to
be returned to applicant within one week from his marking presence before the Assistant Registrar as stated earlier. 7) Application is allowed in the aforesaid terms. (A.S. GADKARI, J.)
