By this First Appeal, the Appellant original Claimant is challenging the Judgment and Award dated 21.3.2014 passed by Railway Claims Tribunal, Mumbai in O.A No.(IIu)/MCC/ 2009/0620 dismissing the appellant's claim for compensation of Rs.4 lakh.
Considering the submissions made by the learned Counsel for the Appellant and the Judgment and Award, following order is passed:
a) Admit.
b) Printing is dispensed with.
53fa42.doc c) Appellant to file private paper book within one year from today, failing which First Appeal shall stand dismissed without further reference to the Court.
d) Registry is directed to call R & P immediately.
e) Hearing is expedited.
f) Liberty is granted to the appellant to apply for fixing early date of hearing after filing private paper book and receipt of R & P.
g) The learned Counsel for the Respondent waives service.
