Apprehending arrest in connection with Crime No. I-253/2020 registered with MIDC Rabale
2/3 Police Station for the offences punishable under Sections 357, 380, 427 read with Section 34 of the Indian Penal Code, the applicant is seeking pre-arrest bail. It is alleged, the applicant and the co-accused committed the offence of house breaking in order to commit and committed the offence of theft. The complainant is a watchman, who had seen the coaccused while committing the offence and when raised alarm, all fled the scene of offence. Next allegation is that, the applicant and the co-accused damaged the windshields of eighteen autorickshaws parked in the compound of the Society. In consideration of the facts and in view of the criminal antecedents, i.e. two offences registered against the applicant, in my view, it is not a fit case to grant pre-arrest bail to the applicant. The application is rejected.
