Heard learned Counsel for the applicant and learned APP for State.

The applicant is seeking pre-arrest bail in connection with Crime No.I-255/2020 registered with Koparkhairane Police Station for the offences
2/3 punishable under Sections 326, 323, 504, 506, 143, 145, 147, , 149 of the Indian Penal Code.

On pretext of settling the past dispute, complainant was called and assaulted by a members of unlawful assembly by sharp edged weapon. The complainant had suffered grievous injury over scalp of fronto parietal region, CLW 16 cm x 2 cm. Though applicant has not been attributed the role of inflicting grievous injury on the person of the complainant but his presence at the scene of offence is evident from the CCTV footage retrieved by the Investigating Officer. 4.
Learned Counsel for the applicant, submits that, applicant has no criminal antecedents and being government servant, if he is arrested, it may lead to serious consequences.

In consideration of the facts of the case, applicant is granted liberty to move the application for regular bail and if application is moved, the learned Court shall decide the said application on the same day, without being influenced by this order.

With the aforesaid observations, the applicant is permitted to withdraw the application with liberty as prayed for. The application is disposed off.

It is made clear that observations made hereinabove be construed as expression of opinion only for the purpose of granting bail and the same shall not in any way influence the trial in other proceedings. Digitally signed by Neeta S.
