Mr. Venegavkar, learned counsel for respondent No.2 raises an objection regarding the maintainability of this petition including the notification dated 12th May 2021 issued by the respondent No.2 at the instance of the petitioners who are the teachers of various schools run by the respondents. It is submitted by Mr. Venegavkar, learned counsel for N. S. Chitnis 1/2

11-wp.3721.2021.doc the respondents that out of 8 institutions, 6 institutions have already accepted and implemented the notification dated 12th May 2021 issued by the respondent No.2.

In view of this objection raised by the learned counsel for the respondent No.2, Mr. Shah, learned counsel for the petitioners, on instructions from some of the petitioners, who are present in Court, and are authorised to issue instructions to withdraw the petition, seeks permission to withdraw this writ petition with liberty to file appropriate proceedings. 3.

Writ Petition is accordingly dismissed as withdrawn with liberty as prayed. No order as to costs 4.

Since the Management who is the employer of the petitioners is not before this Court and the ad-interim order dated 5th August 2021 passed by this Court was to protect the Management, the said ad-interim order stands vacated.
