After arguing the matter for sometime, Mr. Gole, learned counsel for the petitioner on instruction seeks liberty to withdraw this petition with liberty to file appropriate application before the Civil Court in the pending suit, in view of the subsequent development. 2.

Writ Petition is disposed off as withdrawn with liberty as prayed. 3.

It is made clear that this Court has not expressed any views on the merits of the application that would be filed. If any such application is made for interim relief by the petitioner before the Civil Court, the Civil Court shall decide the said application on its own merits after
