There is no research which needs to be conducted before public interest litigation is filed. The petitioner desires reservation for children of project affected persons in higher education i.e. graduation and above. As per the petitioner for children of project affected persons 2.5% reservation in schools has been provided.

2 21.111.18 pil.doc As per clause 5 of the Article 15 of the Constitution of India, a State can make special provisions for advancement of social and educational backward classes of citizens as also scheduled castes or scheduled tribes. There is no research nor any data that children of project affected persons would be entitled to reservation in higher education. In the absence of any data, we close the proceedings in the petition which is dismissed.
