DATED : 16th MARCH, 2022 P.C:- Respective counsel for the parties unanimously state that the discord has been settled between them and the consent terms are accordingly filed before the City Civil Court. In the wake of the aforesaid, the Appeal is sought to be withdrawn, which I see no hesitancy to be permitted to be withdrawn. The decretal amount which has been deposited in this Court in terms of the order dated 18/2/2019 as well as the deficit amount of Rs.50,000/- directed to be deposited by order dated 28/2/2020, shall be permitted to be withdrawn by the appellant, since it forms terms of the settlement and the appellant is permitted to retain the said amount.
