Heard learned counsel for the applicant and the learned APP for the State.

This is an application for pre-arrest bail in connection with C.R. No.17 of 2020, registered with Lonikand Police Station, Pune Rural, for the offence punishable under Section 420 of the Indian Penal Code, 1860.

The indictment against the applicant is that in the year 2019, co-accused Yogesh Navkhande was residing in the room of the first informant at Wagholi. The applicant and the co-accused withdrew a sum of Rs.5,23,380/- from the account of the first informant and also availed gold loan by pledging the gold ornaments of the first informant. The applicant and the co-accused allegedly removed the household articles and goods from the house of the first informant.

The learned counsel for the applicant submits that the coaccused Yogesh Navkhande was arrested and released on bail. The applicant is married and settled in Delhi. Her custody is not necessary.

The incident occurred during April-2019 to September2019. The first report lodged on 7th January, 2020. 5.

Learned APP on instructions submit that the charge-sheet is filed against the applicant under Section 299 of Cr.P.C. 6.

The custodial interrogation of the applicant is not necessary. The co-accused Yogesh Navkhande was arrested and released on bail.

Considering the aforesaid circumstances, this application can be allowed.

ORDER

i.

Anticipatory Bail Application No. 1718 of 2022 is allowed;

ii.

Interim order dated 29th June, 2022 is confirmed. iii.

In the event of arrest of the applicant in connection with C.R. No. 17 of 2020 registered with Lonikand Police Station, Pune Rural, the applicant be released on bail on furnishing P. R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount;

iv.

The applicant shall co-operate with the investigating officer as and when called for.
