P.C:- The applicant face charges u/s. 420, 465, 467, 468, 471 r/w Section 34 of IPC in C.R.No. 843/2021 registered with Andheri police station on 3/10/2021. The said C.R also arraign her husband as accused no.1 and it is informed that he has been arrested, investigation has been completed and charge-sheet has been filed, wherein he was shown as 'Absconding'. On perusal of the material compiled in the chargesheet, it can be seen that on the complaint filed by one Minakshi Bhatade on 3/10/2021, the said C.R came to be registered accusing the applicant and her husband of duping the complainant of an amount of Rs.15,000/- on the pretext that she

The duo worked in sync with each other and on contacting the present applicant, she guided him to her husband, who established contact with the complainant on mobile phone, asked her documents for verification and directed her to make payment of Rs.15,000/- for the purpose of training as well as opening an account for salary. When she questioned him about the training and the job, it was found to be not existing at all, she was given an offer by the accused no.1 to make herself available for sex. This resulted in invoking Section 354D against the accused no.1 at odd hours.

On the C.R. being registered, the investigating machinery was set into motion and the investigation is carried out. It is informed that statement of other persons who have also been duped, in A similar manner also form part of the chargesheet. When these statements are carefully perused, it appears that the amount has been delivered to the accused no.1 by all the victim persons. It is also stated that all the necessary documents have been confiscated from the accused no.1 during the course of investigation and even the bank account has been frozen. In the wake of the above, since the main accused has been arrested and the investigation is complete, the custodial interrogation of the applicant is not necessary as the material against her is already included in the charge-sheet. However, she shall render all co-operation to the Investigating Officer by reporting to him on 4th to 6th July 2022 between 2.00 pm to 5.00

O R D E R

(a) In the event of her arrest, the Applicant - Swati Rahul Sonkar in connection of C.R.No.843/2021 registered with MIDC police station shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount.

(b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.

(c) The Applicant shall report to the Investigating Officer from 4th to 6th July 2022 between 2.00 pm to 5.00 p.m and thereafter as and when directed. The Application is allowed in the aforestated terms. ( SMT. BHARATI DANGRE, J.)
