Heard learned counsel for the applicant, learned additional public prosecutor for the State and learned Advocate for respondent no.2.

The applicant has been convicted by the learned Judicial Magistrate, Vashi for the offence punishable under section 138 of the Negotiable Instruments Act. The cheque amount was Rs. 75,000/-. The appeal of the applicant has been dismissed by the Sessions Court.

During the pendency of the present revision application the dispute has been resolved amicably. The Borey 1/2

spb/ 901revn530-09.sxw consent terms are taken on record and be marked as Exh. "A" for the purpose of identification.

It is submitted by the learned counsel for the applicant that the applicant has paid Rs. 75,000/- to the respondent no.2. Respondent No. 2 is satisfied with the settlement terms and conditions.

In view thereof, following order is passed :

The offence committed by the applicant stands compounded. The applicant has been acquitted of the offence punishable under section 138 of the Negotiable Instruments Act. His bail bond, if any, shall stand cancelled. Fine amount if paid by the applicant shall be refunded by the trial court to the applicant.

Revision application stands disposed of in the above terms.
