Heard the learned Senior Counsel appearing for the Petitioner and Respondent No.3. By the impugned order, the intake capacity of Petitioner's institute is reduced from 80 to 40 and further the Petitioner's application for increase in the intake capacity from 80 to 120 is rejected. The rejection is mainly on the ground of deficiency in faculty.

Mr. Jahagirdar, learned Senior Counsel appearing for the Petitioner pointed out that before passing the impugned order the Petitioner was not heard. Mr. Bukhari, the learned patilsr 1 / 2

Senior Counsel appearing for Respondent No.3 submitted that meeting of the Executive Committee of Respondent No.3 is scheduled on 7th and 8th July 2016 and if the Petitioner wants he can avail the opportunity of hearing before the Executive Committee. He further submitted that decision will be taken immediately. Statement is accepted.

In above circumstances, in our view the grievance of the Petitioner stands redressed. Hence, petition is disposed of. Needless to mention that in case the decision of the Executive Committee is adverse to the Petitioner, the Petitioner may approach this Court. All points and contentions of the respective parties are open.
