This Application is filed seeking condonation of delay of 3 years and 245 days caused in filing the Appeal. The Applicant states that due to some family matter, the Applicant was unable to attend the Court on the day of pronouncement of judgment. Thereafter, nationwide lockdown was imposed on account of COVID-19. The Applicant states that there was no communication between the Applicant and his advocate. Due to COVID 19 the Applicant was not able to move outside due to travel restrictions imposed by the authorities. It is for this reasons delay is caused. Considering the reasons stated that the Appellant in jail the Application is allowed by condoning the delay. Hence following Order is passed. Shubham Talle 1/2

ORDER

a) The Interim Application No 2536 OF 2023 is allowed and disposed of.

b) The delay of 3 years and 245 days caused in filing the appeal challenging the Judgment and Order dated 8th August 2019, passed by learned Additional Sessions Judge, Thane, in Sessions case No. 262 of 2012 is condoned.
