This is an application seeking transfer of divorce petition filed by the Respondent-husband before the Court of Civil Judge, Senior Division, Panji, Goa to the Family Court, Bandra, Mumbai. 2.

When the matter is called out, Mr. Solkar, learned Counsel for the Applicant would submit that reply has been filed in the matter and he has instructions to proceed in the matter without filing rejoinder. 3.

Before the learned Counsel for the Applicant commences his arguments, learned Counsel for the Respondent submits that he has instructions to consent to the transfer, subject to his client, the 1/3

Respondent, being permitted to appear through video conferencing facility before the Family Court at Bandra on dates when the Respondent's physical presence is not required by the said Court. 4.

Learned Counsel submits that the marriage was solemnized between the Applicant and Respondent in Goa and at the time when the divorce proceedings were filed, the Applicant had already gone back to her parental home in Mumbai.

Learned Counsel for the Applicant submits that he has no objection if the aforesaid request of the Respondent is considered. 6.

Having heard the learned Counsel and having considered the submissions made, the Application is allowed in terms of prayer clause (a), which reads thus:- "(a) That this Hon'ble Court be pleased to transfer Marriage Petition No. 24 of 2023 pending before the Hon'ble Civil Judge, Senior Division, Panji, Goa, to Family Court at Bandra, Mumbai."

It is further clarified that the Respondent be permitted to attend the proceedings before the Family Court at Bandra, Mumbai through video conferencing facility on dates, when his physical presence before 2/3

the Court is not required, upon an appropriate application made in that regard.
