1] Applicant is seeking regular bail in C.R. No. 507/2014 registered with respondent Police Station for Offences punishable under Sections 420 r/w 34 of the Indian Penal Code. 2] Accused no. 3 who has pleaded guilty is awarded three years punishment whereas accused nos. 1 & 2 are enjoying pre-arrest bail. Applicant is behind the bars since 08/10/2016 i.e. for last more than 5 years. As such, even if the trial has commenced, this Court needs 1/2

34.2678.21 ba.doc to the sensitive to the fact that applicant has suffered incarceration for last more than 5 years. As such, applicant deserves bail. (i) Applicant be released on bail in C.R. No. 507/2014 registered with respondent Police Station for Offences punishable under Sections 420 r/w 34 of the Indian Penal Code upon furnishing P.R. bond in the sum of Rs. 15,000/- with one or more sureties in the like amount.

(ii) Applicant shall neither influence the witnesses nor tamper with evidence in any manner.

(iii) Applicant shall attend the trial regularly. Any two consecutive absent to attend the trial will entail the Trial Court to initiate proceedings for cancellation of bail.
