On 29/06/2022, by a detailed order, the applicant was admitted to interim protection from arrest, particularly by recording that the accusations are to be looked into in the background of the civil nature of the proceedings. 2.

Learned A.P.P. states that in terms of the direction, the applicant has reported to the police station and has rendered his co-operation.

Since it is already observed in the order dated 29/06/2022 that the dispute between the complainant and the present applicant, being civil in nature and, since, civil remedies are already resorted to, the interim protection deserves to be confrmed. This is, however, subject to the stipulation that the applicant shall not enter the subject property of the C.R. belonging to the complainant. : ORDER :

(a) Application is allowed.

(b) In the event of arrest in connection with C.R.No.240 of 2022 registered with M.H.B. Colony Police Station, applicant-Ramesh Dahyalal Shah shall be released on bail on furnishing P.R. Bond to the extent of Rs.25,000/- with one or two sureties in the like amount.

(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Offcer and should not tamper with evidence.

(e) The applicant shall not enter the subject property of the C.R. belonging to the complainant. 4.

In view of the disposal of the application, interim application does not survive and stands disposed off. ( SMT. BHARATI DANGRE, J.)
