The applicant was protected by an ad-interim order passed on 29/06/2022, by recording a prima facie case that the nature of dispute between the parties is civil in nature and

2/3 3 ABA-1726-22.doc FIR is a counterblast to the civil proceedings instituted by accused No.1 against the complainant. He was directed to report to the police station on distinct dates. 2.

Learned A.P.P. does not dispute that the applicant has reported to the Investigating Offcer, as directed. 3.

Learned counsel for the applicant has also placed on record the copy of the order dated 29/07/2022 passed in Anticipatory Bail Application No.1721 of 2022, when the interim protection granted in favour of the co-accused came to be confrmed.

Considering the limited role attributed to the applicant and, since, he has abided by the conditions of the interim order, I deem it appropriate to confrm the order dated 29/06/2022, which shall be subject to the following conditions. : ORDER :

(a) Application is allowed.

(b) In the event of arrest in connection with C.R.No.240 of 2022 registered with M.H.B. Colony Police Station, applicant-Deepak Vaishnav shall be released on bail on furnishing P.R. Bond to the extent of Rs.25,000/- with one or two sureties in the like amount.

(c) The applicant shall report to the concerned police station as and when called for.

(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Offcer and should not tamper with evidence.

3/3 3 ABA-1726-22.doc (e) The applicant shall not enter the subject property of the C.R. belonging to the complainant. 5.

In view of the disposal of the application, interim application does not survive and stands disposed off. ( SMT. BHARATI DANGRE, J.)
