DATE : 4TH SEPTEMBER, 2018 P.C:- 1) This is an application under Section 439 of Criminal Procedure Code, filed by the aforesaid applicant who is arrested in C.R. No. 32 of 2018 registered at Tembhurni Police Station, District Sholapur for offence punishable under Sections 489-A, 489-C, 489-D, 353, 332, 201, 120-B read with section 34 of Indian Penal Code.

2) Heard Mr. Ritesh Thobde, learned counsel for the applicant and Mr S.S.Pednekar. learned APP for the State. Perused the records and considered the submissions advanced by the learned Counsels for the respective parties. 3) The aforesaid crime was registered pursuant to the first information report lodged by P.S.I. Shri Pandit Kalyanrao by Radhakishan Shivlal Ladda Date:

Maskehas of Tembhurni Police Station. Perusal of the first information report and the other material on record prima facie reveals that the first informant had received an information that co-accused Ravikant Patil was in possession of some counterfeit currency notes. He was apprehended and it was learnt that the applicant herein was involved in counterfeiting and supplying the notes. On receipt of the said information the first informant proceeded to the place of the co-accused, where Ravikant Patil was apprehended. He has stated that Ravikant Patil had volunteered to show the house of applicant. The first informant along with the said Ravikant Patil and other panch witnesses proceeded to the house of the applicant, as shown by Ravikant Patil.

The first information report reveals that Ravikant Patil had informed them that the currency notes were counted in the room situated on the terrace. The first informant went to the said room along with panchas. Said Ravikant Patil identified the applicant who was present on the terrace. The first informant has stated that on seeking them, the applicant tried to run away from the spot. However, he was caught by the police. It is stated that he also pelted stone on Police Head Constable, B.No.308 Shri Shinde and B.No. 2316.

4) The statements of the other police personnel also prima facie supports the case of the prosecution. The material on record thus reveals that the applicant was not only in possession of counterfeit notes but he was also involved in counterfeiting currency notes.

5) The learned APP has also produced before me the report which shows that notes seized were in fact counterfeit notes. The offence is of serious nature.

6) Considering nature of the offence, which is, in fact an offence against the society, in my considered view, the applicant is not entitled for bail. Application is dismissed. (SMT. ANUJA PRABHUDESSAI, J.)
