The learned APP upon instructions submits that in Sessions Case No. 101 of 2015 charge is framed on 8/12/2015 and till today the learned Sessions Court, Vasai has recorded substantive evidence of as many as five witnesses. In the midst of the trial, it would not be appropriate to consider the application under section 439 of the Code of Criminal Procedure, 1973.
