The petitioner has preferred this petition through jail, hence we appoint Ms. Rohini Dandekar, who is on the panel of advocates of the High Court Legal Services Committee, to represent the petitioner in this petition. 2.

In this petition, the petitioner has a grievance in relation to

9 WP 2378 OF 2013.doc parole leave. He has also stated that he is not being sent to open jail though he is entitled to be sent to open jail. So also he has prayed for commutation of his sentence.

The learned APP has tendered s report of the Superintendent of Kolhapur Central Prison where the petitioner was last lodged. The report shows that the appeal preferred by the petitioner against his conviction and sentence was allowed, hence the petitioner has been released from prison. The said report is taken on record and marked "X" for identification. 7.

In view of the above, rule is discharged.
