Mr. Chavan, learned counsel for the petitioner, on instructions from his client, who is present in the court, seeks leave to withdraw the petition with liberty to file discharge application before Special Court.

Leave with liberty, as prayed for, is granted. The petition is dismissed. It is made clear that in the event such a discharge application is made before the Special Court, the same shall be decided on merits without being influenced by the withdrawal of the present petition.
