The learned Counsel for the applicant fairly submits that in the present case i.e. in MCOC Case No. 15/12, the prosecution has examined as many as 11 witnesses. Hence, it would not be appropriate to consider the application under section 439 of the Code of Criminal Procedure, 1973 in the midst of the trial. In view of this, the learned Counsel upon instructions seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice. Talwalkar 1/2
